1. Acceptance of Terms

By registering for or using SiteHub ("the Service"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use the Service. These terms constitute a legally binding agreement between you ("the Customer") and SiteHub ("we", "us", or "our").

2. Description of Services

SiteHub provides an AI-powered website creation and hosting platform. Our services include:

• AI-generated website creation based on your business information
• Website hosting on the SiteHub subdomain (sitehub.co.za/your-slug/) or your own custom domain
• A self-service customer portal at app.sitehub.co.za for managing and editing your website
• Optional AI credits for regenerating content and images

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Payments & Billing

SiteHub offers three hosting options, all starting with the same once-off setup fee:

All payments are processed securely via PayFast. By completing a payment you agree to PayFast's terms of service. SiteHub does not store your card or banking details.

Your website is activated only after the setup fee payment is confirmed. Annual hosting renewals are due each year on the anniversary of your activation date. Failure to renew will result in your site being suspended until payment is received.

Custom domain notes:

• The "New .co.za Domain" fee covers standard .co.za registration only. Premium, aftermarket, or already-registered domains are not included and must be purchased separately.
• Domain registration is subject to availability at the time of purchase. SiteHub cannot guarantee specific domain names.
• For the "Your Own Domain" option, you remain solely responsible for renewing your domain with your registrar. If your domain lapses, your site will go offline and SiteHub cannot be held liable.
• Domains registered by SiteHub on your behalf ("New .co.za" option) are owned by the customer. Domain transfer to another registrar can be requested at any time; a transfer-fee of R250 applies.
• DNS propagation can take up to 48 hours after domain connection. This is outside SiteHub's control.

Refund policy: Due to the AI generation work performed at sign-up, setup fees are non-refundable once site generation has commenced. Domain registration fees are non-refundable once a domain has been registered. Unused annual hosting fees may be refunded on a pro-rata basis at our discretion where a written request is submitted within 14 days of the renewal date.

4. User Obligations

By using SiteHub you agree to:

• Provide accurate and complete information during sign-up and at all times
• Keep your account credentials secure and not share them with others
• Use the Service only for lawful purposes and in compliance with all applicable South African and international laws
• Not upload, publish, or link to content that is illegal, defamatory, obscene, or infringes third-party rights
• Not use the Service for spam, phishing, or any form of fraudulent activity
• Not attempt to reverse-engineer, scrape, or disrupt the platform or its infrastructure
• Notify us immediately at info@sitehub.co.za if you become aware that your site has been compromised or is being used unlawfully

We reserve the right to suspend or terminate accounts that violate these obligations without refund.

5. Website Content & Prohibited Material

You retain ownership of the content you provide to us (business name, description, images, etc.). By submitting content you grant SiteHub a non-exclusive, royalty-free licence to store, display, and host that content as part of delivering the Service.

AI-generated text and imagery produced by SiteHub during site generation is provided "as is". You are responsible for reviewing and editing all generated content before publishing. SiteHub does not guarantee that AI-generated content is accurate, complete, or fit for any particular purpose.

Prohibited content:

You may not upload, publish, display, or link to any content on your SiteHub-hosted website that:

• Violates any South African law, including but not limited to the Electronic Communications and Transactions Act (ECTA), the Protection of Personal Information Act (POPIA), the Films and Publications Act, the Consumer Protection Act, and the Cybercrimes Act
• Violates any applicable international law or regulation
• Is defamatory, hateful, discriminatory, or incites violence against any person or group
• Contains child sexual abuse material (CSAM) or any sexually explicit content involving persons under 18 — we are legally required to report such content to the South African Police Service and the Film and Publication Board
• Infringes the copyright, trademark, patent, trade secret, or other intellectual property rights of any third party
• Constitutes spam, unsolicited marketing, or deceptive advertising
• Promotes or facilitates any unlawful activity, including fraud, money laundering, or the sale of illegal goods or substances
• Impersonates another person, business, or organisation
• Contains malware, spyware, phishing pages, or any malicious code

Takedown policy: SiteHub reserves the right to remove any content that, in our sole discretion, violates these terms or is the subject of a credible legal complaint. We will take sites down immediately and without prior notice where content is illegal or where we receive a valid takedown notice. Hosting fees for a suspended or terminated site are non-refundable where termination is due to prohibited content.

You indemnify SiteHub against any claim, loss, damage, or expense (including legal costs) arising from content you publish on your site.

6. Acceptable Use

In addition to the content restrictions above, the following uses of the Service are prohibited:

• Using your site to conduct or facilitate any form of online fraud or scam
• Operating a business that requires a licence or permit under South African law without holding that licence (e.g. financial services, gambling, healthcare)
• Reselling or subletting SiteHub services to third parties without our written consent
• Indexing or scraping the SiteHub platform
• Using the Service in a way that causes excessive load on our infrastructure or degrades service quality for other customers

7. Account Termination

Either party may terminate the agreement:

• By you: Submit a written cancellation request to info@sitehub.co.za. Your site will remain live until the end of the current billing period.
• By us: We may suspend or terminate your account immediately for breach of these terms, non-payment, or if we are legally required to do so.

Upon termination your website files will be removed from our hosting infrastructure within 30 days. You are responsible for downloading any content you wish to retain before termination takes effect.

8. Limitation of Liability

To the fullest extent permitted by law:

• SiteHub is provided on an "as is" and "as available" basis without warranties of any kind
• We do not guarantee uninterrupted, error-free, or completely secure operation of the Service
• SiteHub shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service
• Our total cumulative liability to you for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim

9. Intellectual Property

All intellectual property rights in the SiteHub platform, including the portal software, AI generation pipeline, branding, and documentation, are and remain the exclusive property of SiteHub. Nothing in these terms transfers any ownership of SiteHub's intellectual property to you. You may not copy, modify, or distribute any part of the platform without our prior written consent.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these terms by reference. By using SiteHub you consent to the collection and use of your information as described therein.

11. Changes to These Terms

We may update these Terms & Conditions from time to time. When we do, we will revise the "Last updated" date at the top of this page and, where the changes are material, notify you by email. Your continued use of the Service after changes are posted constitutes your acceptance of the revised terms.

12. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the South African courts.
